1. Acceptance of Terms
By creating an account, downloading, or using the Gather OutThere application or website ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of the Service
Gather OutThere provides tools designed to facilitate group gatherings, outdoor expeditions, camping trips, and social meetups, including:
- Gathering Planning: Event scheduling, RSVP coordination, and theme customization.
- The Gear Matrix: Collaborative packing checklists with item assignment and claim verification.
- The Trip Wallet: Local and cloud vaults for gate codes, campsite reservations, and emergency notes.
- Caravan Radar: Voluntary, day-of live distance and ETA tracking among gathering participants.
- Community Explore Map: Crowdsourced spot discovery, digital passport check-ins, and trail points of interest.
- Logistics Chat: Group communication channels for trip members.
Outdoor & Wilderness Safety Disclaimer: Gather OutThere is a planning and logistics utility. It is not an emergency beacon, certified navigational system, or survival tool. Outdoor recreation entails inherent risks including weather extremes, terrain hazards, and wildlife encounters. Users are solely responsible for exercising personal judgment, obeying local land-use laws, verifying trail and campsite conditions, and carrying appropriate emergency and survival gear.
3. User Accounts & Security
- You must provide accurate information when registering for an account.
- You are solely responsible for maintaining the confidentiality of your credentials and for all activities occurring under your account.
- You must notify us immediately if you suspect unauthorized access or security breaches.
- We reserve the right to suspend or terminate accounts that violate these Terms or compromise community security.
4. Acceptable Use & Community Guidelines
When using Gather OutThere, you agree that you will not:
- Post inaccurate, fraudulent, or hazardous coordinates or pins on the Community Explore map.
- Use the live Caravan Radar to stalk, harass, or non-consensually track any individual.
- Store illegal, malicious, or abusive materials in shared event notes or Trip Wallets.
- Transmit spam, unsolicited advertisements, or harmful software through group chats.
- Interfere with or compromise the integrity, security, or performance of our cloud infrastructure.
5. User-Generated Content & Intellectual Property
- Your Content: You retain ownership of all text, images, notes, and checklist items you submit to Gather OutThere.
- License to Operate: By posting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and display that content solely for the purpose of operating and providing the Service to you and your designated gathering attendees.
- Our Intellectual Property: The Gather OutThere name, brand logos, UI designs, code, and graphics are the exclusive property of Gather OutThere. You may not copy, modify, or distribute our proprietary materials without written permission.
6. Privacy
Your privacy is paramount. Please review our Privacy Policy to understand how your data, location coordinates, and event details are collected, processed, and secured.
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not warrant that:
- The Service will be uninterrupted, error-free, or continuously available in remote or cellular dead-zone areas.
- Maps, directions, community markers, or weather-sensitive details are 100% complete or up to date.
- Data cached in offline vaults will be immune from local device hardware failure or data loss.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Gather OutThere, its creators, developers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, personal injury, property damage, or outdoor hazards arising from your use of or inability to use the Service.
9. Account Termination
You may terminate your account at any time using the in-app deletion button located at Settings > Delete Account. We may suspend or terminate your access to the Service at our discretion if you violate these Terms.
10. Modifications to Terms
We may update these Terms from time to time. When changes occur, the "Last Updated" date will be updated. Your continued use of Gather OutThere after any modifications constitutes acceptance of the new Terms.
